Rolle Defender Tries To Shift Suspicion

Jurors Heard Testimony Of The Owner Of A Vehicle Found Near The Woman's Body. Closing Arguments Are Expected Today.

April 16, 1997|By Frank Stanfield of The Sentinel Staff

TAVARES — The owner of a Land Rover sport utility vehicle abandoned near the body of an unidentified woman testified Tuesday that he had nothing to do with her ****, torture and strangulation in 1991.

Alexander Broumand said his 1989 Land Rover was stolen in August 1991 from a parking lot near one of his former businesses, Calico Jack's restaurant and lounge in Kissimmee. Investigators found it several months later, on Dec. 7, near the body of the woman dubbed Jane Doe in a desolate area off State Road 46 in Lake County.

Broumand found himself on the defensive Tuesday, as attorneys for Joseph A. Rolle Jr. tried to shift suspicion to him. Rolle, 30, a fast-food restaurant employee, is charged with sexual battery and first-degree murder.

On Monday, defense attorneys grilled a former employee of Broumand's, Ed Haerter. Haerter, a former bouncer at another bar owned by Broumand, said he led his wife to believe that he was somehow involved with the disappearance of Broumand's Land Rover. Haerter told his then-wife, Jackie, that he had to leave for a while after police found the vehicle parked near the body.

Haerter testified that his remarks to his wife were a ruse so he could leave home and move in with another woman. His wife told police, and his comments - including a rumor that Haerter helped steal the vehicle so Broumand could collect the insurance - ended up in investigative reports.

Assistant Public Defender Michael McDermott questioned Broumand Tuesday about his finances, quoting him in a newspaper story about losses at a downtown Orlando restaurant and citing lawsuits. Broumand testified that he filed for bankruptcy in 1995.

Broumand denied making statements in the newspaper story about losses at the Good Times Cafe, which was in a city parking garage near Church Street Station. He has since sold the restaurant.

He also denied trying to hire a prostitute before he was arrested by vice squad officers in Orlando last year.

''I did not do that,'' he said. He said he ''settled'' the sex case with authorities.

Lake County sheriff's detectives have not been able to identify the woman known as Jane Doe.

She had **** in her bloodstream when her body was found, and she had muscular legs, leading detectives to speculate that she may have been an exotic dancer.

Haerter testified that Broumand tried to get him to go with him to **** clubs in Orlando. When McDermott asked Broumand whether he was with Jane Doe at a biker bar Broumand owned in Apopka, he replied, ''Absolutely not.''

He then suggested Broumand might have attacked the woman in retaliation.

''What did Jane Doe do to you?'' McDermott asked. ''I do not know any woman, Jane Doe, in 1991,'' Broumand said.

Prosecutors are expected to recall Dr. Richard Souviron, a forensic dentist, who has testified that he thinks bite marks found on the woman's body match Rolle's teeth.

The case against Rolle was supposed to focus on DNA, or deoxyribonucleic acid - genetic coding that crime lab specialists say match a blood sample stored in a statewide crime computer. Chances that anyone else could have the same coding as Rolle's are 400 billion to 1, said crime lab analyst David Baer. Rolle's arrest, based solely on a DNA computer data bank, was one of the first in the nation.

Instead, much of the attorneys' attention has focused on bite-mark evidence, and on defense speculation that Haerter and Broumand might have had something to do with the slaying.

The jury is expected to begin deliberating Thursday. Closing arguments are expected today.

https://janedoe.ie/2014/07/27/day-175-december-7th-1991/

Day 175 – December 7th, 1991

Yes, it’s been a long time and yes, there are reasons but they’re uninteresting and irrelevant so let’s move on.

Jane Doe was found on the above date days after she was murdered. Unlike her fellow victims in Blink. her murderer was found and convicted of sexual battery. He was acquitted of her homicide. His name is Joseph Algernon Rolle Jr.

I have spent the past week painting her portrait. Her face, aged between 25 and 40 years old, is slightly perfect. The proportions, the bone structure, the lips – if it wasn’t for the grainy black and white photograph and the tight, papery quality of her skin I would swear she was just having a beauty nap. This is so difficult to write about, even more difficult to paint. I’ve had a crisis of faith of sorts in the past weeks, I lost something and it was with this and another portrait I completed this week that I forced myself to reclaim my passion.

There was no moment of clarity, no spark of inspiration I simply had to sit down and doggedly immerse myself in the work once again. I discovered that balance is impossible in Blink. I cannot delegate between the joys of daily life, of summer and then return to the immense pressure I have laid on myself with this endeavour. I am in or I am out. I’m painting 13 hours a day or 0 hours. There is no middle ground. Unhealthy, perhaps but unfortunately I have yet to find an alternative.

Every time I added another layer of paint to this canvas, every time I screwed up a section and had to restart, every time I wanted to give up I just kept repeating, ‘This woman was murdered.’ Not only was she murdered but no one has lain claim to her for almost 23 years.

Her case file tells us she had given birth to at least one child. How old is he/she? Did they know their mother? Are they still alive or do they have their own place in the unidentified persons database? The questions are endless and yet the facts surrounding her death seem quite clear.

Days after she was **** and murdered, a hiker came across her semi-naked body in the woods in Lake County, Florida. He first thought she was a mannequin. It’s possible that her brown hair with blonde tips camouflaged with the stack of tree limbs she had been temporarily buried beneath. The defence alleged the crime scene had been botched; incompetent investigators brushed debris out her multiple stab wounds after initially concluding that she’d been killed (and covered?) by a bear. Later however, after fully uncovering the posed corpse they discovered a glass bottle protruding from her neck, framed by strangulation marks. A stolen Land Rover was found nearby, the detectives working the case questioned it’s owner but later ruled him out.

Then something happened. Or more correctly, nothing happened for almost 4 years. The case lay dormant, along with Jane Doe’s identity.

February 1995 – a computer matches Joseph A. Rolle’s DNA with semen left on the victim. And suddenly Florida, and some argue, the nation was transported into the modern age of criminal justice.

Like many sex offenders, one victim was never going to be enough for Rolle. And Jane Doe probably wasn’t his first. With a charming demeanour, Rolle found no trouble in attracting women. But he had a reputation for diverging the anger of apparent ill’s in his life onto prostitutes. According to police, when things went wrong at home he picked up working girls and **** them. Of course, the case is the same now as it was then, the word of a street girl is never good enough. Perhaps if someone had listened, Jane Doe could have been spared the brutalisation she endured. In 1992, someone did listen but not to a prostitute. Holding a hacksaw to her throat to enforce compliance Rolle violently **** a woman in a friend’s home.

He was sentenced to a meagre 18 months in a state penitentiary. He served 6 months and was released to choke and forcibly **** another woman four times. He lured her with the promise of crack **** which indicates she may have been a sex worker and so instead of being arrested for sexual battery he was held on the lesser charge of violating his probation. A pattern has seemed to emerge in the convict’s ferocious violence. One victim reported a hacksaw being held at her throat whilst the other was choked. Meanwhile, Jane Doe gets the full package – she was strangled and stabbed in the neck with a glass bottle. Rolle had a record of other crimes ranging from drunk driving to burglary.

After his previous conviction Rolle’s genetic marker is submitted to what was then a state-wide computer database and hey presto the police have a match.

Rolle became one of the first people in the nation to be accused and convicted by a centralised DNA databank. The trial was predictable. The defence argued against the prosecution’s standard of evidence and investigation while the state attorney’s office needed little once the integrity of DNA evidence was explained to a jury who then would have known little on the subject.

The jury came back with a guilty verdict on the sexual battery but felt they could not be sure beyond a reasonable doubt that he went on to kill the victim.

Thankfully, justice would have it’s day. Unlike so many sex crimes both then and today Rolle was not under sentenced. Judge G. Richard Singeltary went above and beyond the sentencing guidelines for Rolle’s crime which was set between 12 and 40 years.

Joseph Algernon Rolle Jr. was sentenced to life in prison where he still resides.

Once again, just as outlined in my previous post, the only reason I was able to recover this information was because the perpetrator’s identity was discovered and made public. Otherwise Jane Doe’s case would only be the sum of the parts of her case file. Justice was served and yet I can’t help feeling unsatisfied. There was no family, no friends sitting on the sidelines to support and remember their loved one while her alleged killer sat comfortably with his mother and sister at his back. The survivor of the first attack for which he was convicted sat solemnly at the sentencing hearing and gave a defiant fist pump to know that she could finally move on with her life.

I hope she thought of herself as sitting in hypothetical solidarity with Jane Doe and all of Rolle’s past and potential future victims too. Jane Doe, in unknowingly sacrificing her life ensured that no more women would fall prey to the barbarity of Rolle.

Victim Of Crime Still Has No Name

The Trial Of Joseph A. Rolle Jr. Is Over. But The Woman He Was Convicted Of Raping Is Unidentified.

April 19, 1997|By Frank Stanfield of The Sentinel Staff

TAVARES — Joseph A. Rolle Jr.'s murder trial is over. He has been convicted of raping an unidentified woman who was brutally killed six years ago.

But Lake County sheriff's investigators and prosecutors are haunted by the case - and not just because a jury did not also find Rolle guilty of first-degree murder on Thursday.

They are haunted because the woman who once had a name and a life will now forever be known as ''Jane Doe.''

No one has stepped forward to claim her body, say who she was or give a substantive clue that would help put a name to the battered face that investigators found in 1991 beneath a pile of tree limbs in a desolate area off State Road 46.

Prosecutors think, however, that they found one person who may have been one of the last people to see her alive.

''She was beautiful,'' Sherie Mitchell testified during Rolle's nine-day trial.

Mitchell owned a beauty salon in Sorrento in 1991 and cut the hair of a woman she thinks was Jane Doe. Mitchell, who also is an artist, was so struck by the woman's beauty that she was able to create a sketch of the woman from memory nine months after the slaying.

When she testified Wednesday, Mitchell conceded that nearly six years after the slaying, ''I don't know if she's the person that's dead.''

But she remembered the woman's distinct earrings, an unusual design of stars and a moon. She also remembered that the woman had a reddish tint to her hair and that she didn't want her hair cut in back.

Assistant State Attorney Bill Gross at one point stopped questioning her during the trial, walked to the evidence table and picked up an earring that investigators found tangled in her hair.

''It does look like it,'' she said. ''I believe that's it.''

She also recalled that the woman in her shop had short hair on the side, and longer hair in the back - just like Jane Doe.

Assistant Public Defender Mark Nacke pointed out that her description differed somewhat in a statement she made to detectives in 1992. She described the woman as having an olive complexion, ''very, very dark hair,'' and an ''Indian look.''

But she also noted that the woman was wearing a white T-shirt with lace ''and something with pink on it.'' Those descriptions seem to fit what Jane Doe was wearing, too, Gross noted. Jane Doe was naked from the waist down, her body posed suggestively, but she was wearing a red sweatshirt and a white blouse beneath the sweatshirt.

Detectives never learned her identity. Noting that she had muscular legs, they figured that perhaps she might have been an exotic dancer, so they visited scores of **** clubs in Orlando and Casselberry.

Authorities even enlisted the aid of the late Dr. William Maple, a world-renowned forensic anthropologist at the University of Florida, to determine her age.

Jane Doe was described as white, 25 to 35 years old, 5 feet 4, 124 pounds, with hazel eyes and brown hair. She had given birth to at least one child, Maples noted.

A homicide bulletin said she had a possible razor design on the sides of her hair. The back of her hair was described as shoulder length with sections of blond tinting. Other physical clues, including a GM car key found near the body and a stolen Land Rover, did not pan out, investigators said.

They were able to find one clue - semen - that ultimately led to Rolle's conviction on one of three **** charges.

The semen matched genetic DNA, or deoxyribonucleic acid, in Rolle's bloodstream, a crime lab analyst testified.

Investigators also sent the woman's fingerprints to 230 cities that have computerized fingerprint searches. There were no matches there, but the response to the police sketch and requests for information was overwhelming, said Stu Hudson, an investigator with the Florida Department of Law Enforcement.

About 240 agencies responded with information about missing persons and unidentified women found murdered in their communities. Hudson had to conduct meetings with police to eliminate cases that were vastly different from the strangulation and torture of Jane Doe.

Because of the meetings, four of those cases were solved, Hudson said.
